This is a non-binding translation. The legally binding version is the German one.
1. Scope
(1) The following General Terms and Conditions (GTC) apply to all deliveries by LIVONDO GmbH in connection with sales and rentals to entrepreneurs and consumers via this website.
(2) An entrepreneur within the meaning of § 14 of the German Civil Code (BGB) is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, is acting in the exercise of their commercial or independent professional activity.
(3) A consumer within the meaning of § 13 BGB is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.

3. Offer and conclusion of contract
(1) The offers from LIVONDO GmbH are a non-binding invitation for you to order goods from us.
(2) Once you have found a product you wish to order, you can add it to your basket by clicking the [Add to basket] button. You can view the contents of your basket at any time by clicking the basket icon at the top right. You can remove individual products from the basket at any time by clicking "Remove". If you wish to buy the products in your basket, click the [Checkout] or [Pay] button. You can order without registering, or you can log in. After entering your email address and delivery address, you reach the selection of delivery and payment options via the [Continue to shipping] button. Once you have entered all your details and selected the delivery and payment option, you will receive a summary of all the information about your purchase. Here you can review your entries and, if necessary, correct any input errors using your browser's back button. The process can be cancelled at any time by closing the browser or by not continuing at this point and continuing to browse our site. By clicking the [Buy] button, you complete the order process and order the selected goods in accordance with the order overview.
(3) For some payment methods, after entering your data and selecting the payment method you have to enter further information on the payment-service provider's payment page. There you follow the further instructions and can complete the order.
(4) With your order, you submit a binding offer to conclude a purchase contract.
(5) The contract comes into effect when we accept your offer within 5 working days of receiving the order. Acceptance is given either
- by an order confirmation in text form (by email, with the receipt of the order confirmation by you being decisive)
- or by delivery of the goods to you (with the receipt of the goods by you being decisive)
If we do not accept within the stated period, this counts as a rejection of the offer. In this case you are no longer bound by your declaration of intent (binding offer).
4. Right of withdrawal
Consumers are entitled to a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.

5. Delivery and delivery time
(1) The delivery time is given on the relevant product page. Sundays and public holidays are taken into account.
(2) Should the goods not reach you in the time we have stated due to an unforeseeable delay at the appointed shipping company, please notify us promptly so that we can investigate with the shipping company.
(3) Please also note that the stated delivery times apply to deliveries within the Federal Republic of Germany. Shipping abroad may take longer depending on the destination.
(4) Should delivery difficulties arise that are not our responsibility, despite a covering transaction having been concluded, we reserve the right to withdraw from the contract. In the event of delivery difficulties, we will inform you without undue delay by email. We may suggest a comparable product. If no such product is available or you do not wish to receive a comparable product, we will refund any payments you have already made. Note: your statutory rights (withdrawal, warranty) remain unaffected.
6. Shipping and transport risk
(1) If you are a consumer: in accordance with the statutory provisions on consumer goods sales, we bear the shipping and transport risk.
(2) If you are an entrepreneur: the shipping and transport risk passes to you as soon as the goods are handed over to the carrier.
7. Retention of title
(1) If you are a consumer: the goods you have purchased remain our property until full payment has been made.
(2) If you are an entrepreneur: the goods you have purchased remain our property until full payment of all claims arising from the business relationship.
8. Prices and shipping costs
(1) Unless otherwise stated on the product page, the prices given are total prices including statutory VAT. Any additional shipping and delivery costs are stated separately in the relevant product description. VAT and other price components are shown separately on the invoice.
(2) Shipping within Germany is free for orders from EUR 25.00 (gross). If shipping costs apply, you can find out the amount on the shipping information page.
(3) The amount of the applicable shipping costs can also be viewed at any time before placing the order, in the basket and during checkout.
9. Payment and payment methods
As a rule, we offer credit card, PayPal and invoice via Klarna as payment methods. We reserve the right not to offer certain payment methods for any given order and to refer you to other payment methods.

10. Liability for defects, warranty
(1) If you are a consumer: the statutory warranty period of two years from passing of risk applies.
(2) If you are an entrepreneur: the warranty period is one year and begins on the date of delivery of the item. The entrepreneur's rights under §§ 478, 479 BGB remain unaffected. The shortening of the warranty period to one year does not apply if the obligation to compensate is based on personal injury or damage to health caused by a defect for which the seller is responsible, or on gross fault on the part of the seller or its agents. Notwithstanding this, the seller is liable under the German Product Liability Act.
11. Storage of the contract text
The contract text is not stored by us. The contract text may consist of the GTC and other legal texts, the offer or the product page and any further information that may be relevant to the transaction. You must arrange to store the contract text in reproducible form for your own records. You can save the contract text by, for example, printing the offer, the GTC and the order summary page or by saving them digitally, for example by taking screenshots or converting the contract text to PDF.
12. Online dispute resolution
If you are a consumer, the European Commission provides an online platform for online dispute resolution.

13. Final provisions
(1) The contractual language is German.
(2) The purchase contracts concluded are subject to the substantive law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods.
(3) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be the registered office of LIVONDO GmbH (Bonn).
(4) If any of the above provisions is wholly or partially invalid due to legal regulations, statutory provisions or changes in the law, all other provisions shall remain unaffected and shall continue to apply in full.
